On today’s topic we’ll answer some listeners’ questions that will be of interest to all of our readers and audience.
First, a listener asked which way to sponsor a parent from Vietnam? Should the parent apply for a tourist visa or should the child in US file an I-130 visa petition on behalf of the parent?
If the US Consulate suspects that the parent will apply for a Green Card after reaching the US, the Tourist visa will probably be denied. The Tourist visa is only meant for applicants who intend to return to Vietnam when the visa expires. The correct way in this case is for the US citizen child to begin the immigrant visa sponsorship process with CIS.
Another listener asked if people coming to the US as immigrants can transfer funds from the sale of real estate or business in Vietnam.
Regulations frequently change in Vietnam, but according to the latest information that we have, the intending immigrant can take documents related to the sale of property or business to a bank in Vietnam and deposit the money. The bank must have overseas transaction services.
The immigrant should explain clearly his/her purpose for the account and the Bank will instruct him how to obtain the funds after arrival in the US.
What about the new laws that Governor Brown has approved?
Starting in January 2015, illegal immigrants will be able to apply for California State driver’s licenses, though these licenses cannot be used for Federal ID purposes. It appears that licenses may also be obtained by overstayed visa holders.
And, now illegal immigrant lawyers can practice law in California, and illegal immigrant students can get in-state tuition and financial aid. What will come next?
The California politicians will probably find other ways to help illegal immigrants, as long as these ways do not conflict with Federal laws.
It looks like Congress is finally getting closer to approving some sort of legalized status for the 11 million illegals. With that status, they will be able to do almost everything a permanent resident can do.
Why does ICE (Immigration and Customs Enforcement) lock up so many illegal immigrants even if they are just guilty of minor infractions?
ICE is locking up more persons than ever before, and spending much more money than in previous years. Back in 2009, Congress passed a law requiring ICE keep a minimum of 33,400 persons locked up at all times. ICE is forced to spend $120 per prisoner per day. This costs the taxpayers $2 billion annually.
Private companies, like the Corrections Corporation and the Geo Group, have government contracts to run prisons for over 60% of ICE detainees. The stock of these two-publicly traded companies has roughly doubled over the past 3 years. In 2012, an ICE administrator ordered employees to increase arrests in order to meet the requirement of imprisoning 33,400 illegals. That former ICE administrator is now an executive for one of the companies mentioned above.
Republican senators have put an amendment into the new CIR bill which would require ICE to triple arrests in the Southwest. This would add $1.5 billion to the cost of imprisoning inmates over the next 10 years.

A.2. The money cannot be transferred to the US until the immigrant arrives there.

A.3. In 2014, many members of Congress will be busy preparing for re-election. They will not have the time or interest to devote to immigration reform. If that happens, immigration reform will again fail to become a reality.
